Dear Ms. Washington:

We are writing to comment on the topic of trademarks and domain names.

The trademarks owned by Jockey International, Inc. are valuable corporate assets. Substantial time, effort and monies have been expended in advertising, promoting and protecting its many trademarks, including the famous JOCKEY wordmark and we have achieved tremendous consumer recognition and goodwill worldwide. The Internet is an ever-expanding, rapidly growing part of today's technological age and management of this media is crucial to the protection of our trademarks. We concur with the INTA proposal: the recommendations put forth are both necessary and warranted to protect the trademark assets of companies worldwide.

We recently found a company using the name TKO DISTRIBUTORS.COM. This company advertises a line of sportswear items being offered for sale on the Internet. We learned that this is a small company. Nonetheless, because TKO is a trademark owned and used by Jockey International, Inc, to identify apparel, including sportswear, we had a concern regarding confusion. We have worked out an amicable solution: the company will change its name . This small company will incur substantial cost that could have been avoided if the INTA proposal was in place.

We have also encountered a company using JOCKEYS.COM, as its domain name. That is certain to cause confusion with our company and its activities and products. We believe this kind of conflict will not occur in the future if the INTA proposed controls and procedures for the formal registration and renewal of Internet domain names are implemented.
