Dear Ms. Washington:
Any legislation or rule making concerning Internet Domain names must subject such names to the
trademark laws of the NAFTA countries.
I am currently in a dispute for a client concerning a domain name and related trademark of a
Canadian company that is identical to a U.S. trademark held by a client of mine. The use of the
domain name (Sixnet.com) and related mark (Six.Net) has produced confusion. My client who
manufactures electronic communication equipment under the name Sixnet, has received calls from
customers that are worried that his company will not be available for maintenance of their
equipment or for additional products to expand their systems since it appears he is branching out
into an unrelated field.
I believe that at a minimum a cross tie between trademarks and domain names must be maintained throughout NAFTA and if that cannot be arranged with Canada and Mexico then at least the U.S. should implement such a program.
